If you own property within 150 feet of our property and you did not execute a settlement before the October 26, 2012 deadline you were named as a defendant in our Amended Complaint filed on October 29, 2012.

For nearly two years we have attempted to negotiate a consensus development plan with our neighbors concerning the redevelopment of our property. Unfortunately, those efforts were unsuccessful. We offered a host of site plan modifications including robust green space, 22-acres of passive parks, and even substantial financial compensation. Yet the neighborhood rejected all of those offers. Because the vast amount of time, energy, and resources that we spent failed to produce a consensus agreement, we were constrained to initiate a lawsuit on August 23, 2012 to clarify our property rights.

After the filing of our initial complaint, we provided our neighbors 60-days to resolve the issue of our property rights.

On October 29, 2012 an Amended Complaint was filed naming all defendants living within 150 feet of our property (shown highlighted in yellow on the map above) who elected not to settle. Service of process of the Amended Complaint began on November 6, 2012.
